Disclaimers
We do not possess the capacity to guarantee the results achieved by the "Client". We cannot guarantee that the "Client" will attain any specific result, whether positive or negative, financial or otherwise, through the utilization of our "Services" and materials. The "Client" success is influenced by numerous factors that are beyond our control. Results may vary significantly.
While our "Consultants" may offer advice and alternative perspectives on problem-solving and solutions, "Client" understand that these discussions are merely perspectives and are not binding upon the "Client", nor do they constitute prescriptions.
We explicitly disclaim any responsibility for the choices, actions, results, use, misuse, or non-use of the information provided through our "Services". We bear no liability for "Client" 's choices, actions, results, use, misuse, or non-use of the information provided through our "Services" in any way.
By choosing to work with us, you acknowledge that you are capable of taking care of yourself. In the event of psychological issues, we strongly advise you to consult a licensed healthcare professional, doctor or psychologist prior to using our "Services". None of the "Services" provided should be interpreted as a replacement for the guidance of a licensed professional.
You are responsible for your own decisions, behavior, and the consequences thereof during the time we provide "Services" and thereafter. We are not liable for any direct or indirect damages, emotional harm, or damage resulting from decisions you have made, including harm to other participants. If you cause damage to our property, the property of third parties we collaborate with, or to other participants, we reserve the right to recover the costs of the damage from you.
Labuzik “Services” encompass those of TalentDNA, TeamMatrix and Connective Communication/ Connective Excellence and associated services.
Service Availability
Labuzik Ltd. reserves the right to modify the assortment of "Services", including changing or replacing modules in any listed courses and training programs. This includes adjustments to dates, times, availabilities, and prices, as necessary and determined by the directors, partners, and suppliers. Any relevant modifications will be promptly communicated to the client.
We will make reasonable efforts to notify clients of any modifications to our services. Notification may occur through email, updates on our website, or other means deemed appropriate by Labuzik Ltd. It is the responsibility of the client to regularly check their email and our website for updates regarding our services.
Payment
Prices are quoted in GBP Sterling. As we offer "Services" online and cater to "Clients" located in various regions, equivalent amounts in other currencies may be provided. Prices are valid at the time of order validation by the "Client".
We reserve the right to change the fees/packages offered but will always honour the agreed price for the agreed time period of any "Services" that were set at the time of "Client" making a "Booking". However, should "Client" wish to continue to use more of our "Services" after the completion of your initial "Services" they booked, there will be no guarantee that the price will remain the same.
Accepted methods of payment include bank wire transfers, cheques payable in GBP Sterling (from an England based bank account, at least three weeks prior to the course), or cash (for payments smaller than £2000). For alternative payment methods, please contact Labuzik Ltd. by telephone or email.
Please note that certain "Services" may offer payment in "Instalments". To learn about the specific terms and conditions that apply, including the number of instalments required and any variations based on "Service" types, please contact us at info@labuzik.com. We reserve the right to decline instalment payment requests. If Labuzik and the "Client" mutually agree to the instalment payment option, the "Client" is obligated to pay all "Instalments" in full and on time. When choosing a payment plan, "Client" is responsible for making sure the agreed funds are available to be processed or that they process the "Instalment" on the agreed dates. We reserve the right for delayed payments to incur an additional fee of 20% of the amount for the invoiced amount, if the payment is delayed by more than 5 working days or alternatively £100 for each week of delayed payment. Additionally, there will be a £40 administration fee each time we need to chase delayed payments (sending reminders). Note that the reminder email will be sent on the second day after the payment due date.
Cancellation and Refund Policy
Due to the fact that we sell digital "Services" in the form of self-study online courses and hybrid programmes, and they cannot be returned due to their nature, all payments for digital "Services" are non-refundable.
Cancellation by Labuzik Ltd.
While we make every effort to ensure that "Services" are delivered as scheduled, we reserve the right to modify or cancel a "Service" at any time. In the event of a complete "Service" cancellation by Labuzik Ltd., we commit to fully refunding the relevant "Payment" or offering a rescheduled date that is convenient for the "Client".
Cancellation by Client
Client Requests for postponement will be considered on a case-by-case basis and are subject to the discretion of Labuzik Ltd., with an applicable amendment charge, if required.
o 2-3 weeks prior to the Service: 25% of "Service" price
o 1-2 weeks prior to "Service" delivery: 50% of "Service" price
o 1 week prior to "Service" delivery: 75% of "Service" price
o Less than 48 hours prior to "Service" delivery: 100% of "Service" price
o 4 weeks in advance: 25% of "Service" price
o Up to 10 working days prior to "Service" delivery: 50% of "Service" price
o Up to 5 working days prior to "Service" delivery: 75% of "Service" price
o Less than 5 working days prior to "Service" delivery: 100% of "Service" price
Punctuality
Clients are expected to arrive at the designated time as communicated in the "Service" welcome information or email. If a client fails to show up after 10 minutes without notifying the consultant or office through telephone, text, or email, the consultant may leave, and no refund will be offered.
Force Majore
Labuzik Ltd. will make every effort to fulfill the agreement as agreed upon, but shall not be liable for any loss (direct or consequential) incurred by the client in the event that Labuzik Ltd. is unable to complete work, provide "Service", in whole or in part, due to circumstances beyond its reasonable control. Such circumstances may include acts of God, government regulations, illness, labor disputes, war, or terrorism. Labuzik Ltd. cannot be held responsible for any expenses incurred by clients due to course postponement or cancellation.
Consultants
While we strive to allocate named consultants as requested, we cannot guarantee their availability due to the nature of our work and existing "Client" commitments. In the event that a named "Consultant" is unable to provide the "Service" due to sickness or personal emergency, we will endeavour to provide a suitable substitute Consultant. Only if Labuzik Ltd. is unable to provide any Consultant will a refund be considered.
Foreign Clients
Each "Client" attending in-person "Service", is responsible for their own visa, travel, and administrative arrangements. It is strongly recommended that clients requiring a visa, apply well in advance, as Labuzik Ltd. cannot make exceptions to the refund policy in such cases.
Languages
"Clients" should have a good working knowledge of English. If "Client's" proficiency in English is insufficient, we can arrange for an interpreter. The cost of hiring an interpreter will be determined and discussed before "Client" submits completed registration form. "Client" has the option to choose their own interpreter or allow us to provide one for them. In either case, the "Client" bears the cost.
Audio/Visual
Client
Unauthorized video or audio recording of any session, webinar, seminar, retreat, workshop or any other "Services" conducted by Labuzik Ltd. and associated "Consultants" is strictly prohibited unless expressly agreed upon in writing. If permission for recording has been granted, it is understood that the footage/audio is for personal use only and will not be used for commercial gain or published on any media or social platforms.
Labuzik Ltd.
Photos taken by Labuzik Ltd. during the course of providing 'Services' will not be used on social media or elsewhere without the explicit written consent of the respective 'Client'.
However, it is important to note that Labuzik Ltd. may occasionally film or photograph segments of a program ('Services') for internal team training or external marketing purposes. ‘Clients’ who do not wish to be included in such recordings must inform Labuzik Ltd. in writing no later than 2 working days prior to the 'Service' delivery.
‘Clients’ attending online calls, training, or services may be recorded for internal team training purposes. Upon entering the digital room (e.g., MS Teams, Zoom), clients are notified that the session is being recorded by the software used (e.g., MS Teams, Zoom). If clients prefer not to be recorded, they are required to notify the ‘Consultant’ promptly.
Intellectual Property
Labuzik Ltd. shall retain ownership of intellectual property rights and copyright in any materials (including workbooks, audio and video materials, manuals, or other collateral and materials provided), unless a specific written agreement is made to assign rights to the client. All materials provided before, during and after the delivery of the "Service", directly or indirectly, are proprietary information of Labuzik Ltd. and are intended solely for the "Client". They may not be reproduced or shared with another "Client" or other individuals or organisations without explicit authorization. "Clients" are allowed to use the materials for personal use after the "Services" have been completed.
Confidentiallity and Relationships
During the term of Labuzik providing "Services" to the "Client", and for a period of 12 months after completion, the "Client" agrees not to offer employment or engage the services of any "Consultants" involved in the "Services" provided by Labuzik Ltd. In the event, that such employment or engagement occurs, the Client will be liable to pay compensation equivalent to one year's full-time fees for the respective Consultant to Labuzik Ltd.
Governing Law
These Terms and Conditions and our relationship with the "Client" are governed by and interpreted in accordance with English law. Claims can only be brought against us if they can be made under English law without reference to the laws of any other country.
